Terms of Service

These are the terms that govern your use of stack4solo. We have written them to be clear and fair — this is a real agreement between you and us, so please read it.
1. Acceptance of terms
By creating an account or using stack4solo (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms form a binding agreement between you ("Tenant" or "you") and stack4solo ("we," "us," or "our"). We reserve the right to update these terms at any time with notice to registered users.
2. What stack4solo provides
stack4solo is a software-as-a-service platform that enables solopreneurs to create and operate online business storefronts including booking systems, online stores, restaurant ordering, and more. We provide the technology platform only. You are responsible for operating your business, fulfilling orders and appointments, complying with applicable laws, and all interactions with your customers.
3. Account registration
You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@stack4solo.com if you suspect unauthorized access. You must be at least 18 years old to use the Platform. Each account may only be used for a single business.
4. Acceptable use
You agree to use the Platform only for lawful purposes. You must not use stack4solo to sell illegal products or services, engage in fraud or deception, collect or process personal data in violation of applicable privacy law, send unsolicited communications (spam), attempt to gain unauthorized access to our systems, or engage in any activity that disrupts or interferes with the Platform. We reserve the right to suspend or terminate accounts that violate these terms without notice.
5. Your content and data
You retain ownership of all content you upload to the Platform (product listings, images, business information, etc.). By uploading content, you grant us a non-exclusive licence to store, display, and serve that content solely to operate your storefront. You are responsible for ensuring you have the rights to use any content you upload, including images and text. We do not claim ownership of your business data or your customers' data.
6. Subscription and billing
Access to the Platform requires an active paid subscription (except during any free trial period we offer). Subscription fees are billed in advance on a monthly or annual basis. All fees are in Canadian dollars unless otherwise stated. Subscriptions automatically renew unless cancelled before the renewal date. No refunds are issued for partial billing periods. We reserve the right to change pricing with 30 days' notice to active subscribers.
7. Free trials
We may offer a free trial period at our discretion. At the end of a free trial, your account will transition to a paid subscription unless you cancel. We reserve the right to limit or modify free trial terms at any time.
8. Customer transactions
stack4solo facilitates transactions between you and your customers (orders, bookings, inquiries). We are not a party to these transactions. You are solely responsible for fulfilling orders and appointments, resolving disputes with your customers, collecting and remitting applicable taxes, and complying with consumer protection laws. We are not liable for any disputes, refunds, or claims arising from your business transactions.
9. Payment processing
Payments between you and your customers are handled directly by you or by payment processors you configure (such as Stripe, Razorpay, or UPI). stack4solo platform subscription fees may be processed through Stripe. By using these payment services, you agree to their respective terms of service. We are not liable for payment processing errors, failures, or unauthorized charges by third-party processors.
10. Intellectual property
All software, designs, code, and content that comprise the stack4solo platform are owned by us or our licensors. These Terms do not grant you any rights in our intellectual property. The stack4solo name, logo, and branding are our trademarks and may not be used without prior written consent.
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy, available at stack4solo.com/privacy. By using the Platform, you consent to the practices described in that policy. You are responsible for your own privacy obligations to your customers under applicable law, including PIPEDA.
12. Service availability
We aim to maintain high availability but do not guarantee that the Platform will be uninterrupted or error-free. We reserve the right to perform maintenance, updates, or temporary downtime with reasonable notice where possible. We are not liable for losses arising from planned or unplanned downtime.
13. Disclaimer of warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will meet your specific business requirements or that it will be error-free.
14. Limitation of liability
To the maximum extent permitted by applicable law, stack4solo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including lost profits, lost revenue, lost data, or business interruption. Our total liability to you for any claim arising from these terms or your use of the Platform shall not exceed the amount you paid us in the 3 months preceding the claim.
15. Termination
You may cancel your account at any time through your account settings or by contacting us. We may suspend or terminate your account immediately if you violate these terms, fail to pay subscription fees, or if we are required to do so by law. Upon termination, your storefront and dashboard will be deactivated. We will retain your data for 30 days after termination to allow for data export requests, after which it may be permanently deleted.
16. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
